User Agreement

Chapter1. General Rule

Article 1 (Purpose)

Purpose of this agreement is have World Recreation Education Association (here in after called as “WREA”) and Recreation Education Center (here in after called as “REC”) to provide service and set rights and responsibilities of user, liabilities and other necessary matters based on the inter-cooperation through website (www.wrecreation.com / www.iwrea.com) .

Article 2 (Name and Location)

①	Education Association shall be named World Recreation Educational Association.
②	Remote Education Training Center shall be named Recreation Educational Center.
③	WREA and REC is located at 4th Floor of Hansung Building, 89-10 Munjung-dong, Songpa-gu, Seoul.

Article 3 (Agreement’ Effect and its Modification)

①	This agreement shall be effective as it notifies the member through WREA and REC website or by informing it via e-mails.
②	WREA and REC may change the agreement contents without prior notice if there’s a important issue, and modified agreement shall be effective by notifying or informing it in methods described in clause 1.
③	If member doesn’t agree to the agreement, one may request a membership withdrawal, but if they continue to use the service after the effective date of the modified agreement, one shall be considered as agreed to the agreement.
④	WREA and REC accounting is operated separately, and their rights and responsibilities are stated on the registration application.

Article 4. (Regulations not stated in the Agreement)

①	For issues or interpretations not specified in this agreement, one should follow electronic communication basic law, electronic communication business law, and information and communication network use promotion law and other related legal regulations.
②	WREA and REC may set a separate use agreement (here in after called as “charged service agreement etc”) and policy for charged service and individual services, and if such contents shall contradict with this agreement, charged service agreement shall be prioritized.

Article 5. (The definition of a term)

Major terms used in this agreement are defined as below.

①	“USER” refers to the individual, corporate, or group equal to corporate that signed a user contract with WREA or REC.
②	“ID” refers to the combination of letters and numbers approved by WREA or REC and selected by the user to use service and to identify the user.
③	“Password” refers to the combination of letters and numbers set by the user to protect user’s privacy and to identify the user with the information match. 
④	“Service” refers to the general service of using WREA or REC regardless of one’s terminal (including various types of wired and wireless equipments like PC, portable terminal etc) 
⑤	“WREA” stands for a World Recreation Education Association.  WREA is an education association that provides a service under mutual agreement with REC to spread recreation culture around the world.
⑥	“REC” refers to a Recreation Education Center, and it is a remote education training center that provides the charged and free service through remote educations under mutual agreement with WREA.
⑦	“Charged Service” refers to various online digital contents and general services provided by WREA or REC with additional charge, and “Free Program” provided by REC refers to the various online digital contents service provided for free. (Yet, if the “MEMBER” wishes to acquire a license or a certificate of completion of free program, one needs to pay the designated amount.
⑧	“POSTING” refers to the information units uploaded by the user on two-way websites including posting board, public data room, and individual homepages. 
⑨	“Terminal” refers to all information and communication equipments including PC and Modem etc. installed by the user to receive service.
⑩	“Use of Service” refers to all communication actions from the moment user accessed HOST of WREA or REC via terminal until one ended the service.
⑪	“Use Request” refers to the action of requesting it by a separate standard and procedure set by WREA or REC.
⑫	“Use Approval” refers to the action of approving user to use the service as user satisfies the requirements set by WREA or REC or as a resolution of such conditions including late, use stop or termination.
⑬	“Termination” refers to the action of WREA and REC or user terminating the use agreement after the service has started normally.

Chapter2. User Agreement

Article 6 (User Agreement Establishment)

①	If one clicks on “I agree” button after reading this agreement at the time of registration application of WREA or REC, one shall be considered to agree on this agreement.
②	Use agreement is established once a person who wishes to use it requests the service after agreeing to the use agreement and once WREA and REC approves it.

Article 7 (Use Request)

①	A person who may wish to register and use it as a member shall request it by filing the application form requested by WREA or REC.
②	All member information written on online registration application forms are considered as a real data, and if a user did not enter a legal name or actual information cannot be protected by law and one’s service use can be limited.

Article 8 (Protect members’ personal information)

①	WREA and REC protects and respects members’ personal information.
②	WERA and REC collects the information member provides to join the service and to participate in community activities, various events, and member’s personal information is used to execute use agreement and to provide service as described in this use agreement.
③	WREA and REC cannot disclose or distribute member’s personal information acquired related to data and service providence to a third party without one’s approval, and it cannot use it for a commercial purpose. However, this does not apply to the cases below.
I.	In case it is requested by related organization for investigation purpose according to the related law,
II.	In case it is requested by Information and Communications Moral Committee (current Korea Communications Standards Commission).
III.	In case there’s a request following the procedure set in other relevant laws.
④	Within the range described in clause 3, WREA and REC may use collective statistical data on all or partial personal information of the member related to the business.

Article 9 (Approval of Use Request)

①	WREA and REC shall approve the use request following the steps described in article 7 in the order of acceptance unless there’s a specific need.
②	If such cases as described below shall happen, WREA and REC may limit the approval of use request and postpone the approval until such circumstances are resolved.
I.	In case a person responsible for service fee payment did not pay the use fee to the company.
II.	In case there is not enough space in service related facility.
III.	In case there is a technical issue.
IV.	In any other cases that are considered for the need of approval limitation or postponement.
③	WREA and REC may disapprove the use agreement requests if it applies to the following cases.
I.	If the applicant did not request with one’s legal name,
II.	If the applicant used another’s name,
III.	If the applicant entered false information on the required contents at the time of use request,
IV.	If the applicant applied in order to hinder WREA and REC’s activities, society’s order and peace or its general customs,
V.	If one has a history of being forcibly withdrawn being imprudent member,
VI.	In any other cases where use request requirements set by WREA and REC are not met.
④	If WREA and REC shall postpone or disapprove the use request based on clause 2 or 3, they must notify the use request applicant. However, such responsibility could be exempted if WREA and REC cannot notify the use request applicant for a cause that is not attributed by WREA and REC.

Article 10 (Modification of Agreement)

①	Member may always view and modify one’s personal information through personal information management page (www.wrecreation.com/www.iwrea.com). However, legal name, birthday and ID information, which are needed for effective transfer management, cannot be changed.
②	In case the information entered at the time of application is changed, member should modify the information via online system, and member shall be responsible for the issues that occur for not changing the member’s information.

Chapter 3. Responsibilities of Contractor

Article 11 (Responsibilities of WREA and REC)

①	WREA and REC should put in its best effort to provide continuous and stable service as set in this agreement, and in case the equipment problem shall arise or destructed, they must fix and resolve such malfunction.
②	If the submitted complaints or opinions of member are considered reasonable, WREA and REC must resolve such issued according to a proper procedure.

Article 12 (Responsibilities of Member)

①	Member shall be abided by the matters regulated in this agreement, service use guide or cautions posted or notified by WREA and REC. Also, member shall not do any actions that interfere with WREA and REC’s business.
②	Member is solely responsible for one’s ID and password management. Member shall be responsible for all issues caused by improper management or use of the ID and password given to the member.
③	If the member shall realize one’s ID or password was used improper, one shall immediately notify WREA or REC, and the member shall be responsible for all the results occurred by not notifying.
④	Member shall follow the individual use limitations posted on the Notice Board or notified separately by WREA and REC.
⑤	User shall properly execute one’s responsibilities for service fee payment, and user shall be responsible for all issues occurred for not paying the service fee. Yet, the member shall not be responsible for the issues that are caused by WREA and REC’s intentional or negligence.
⑥	Member cannot make deal transactions using service without the pre-approval of WREA and REC, and WREA and REC shall not be responsible for the results of such transactions and member’s all transaction activities against the agreement. If WREA and REC shall suffer any loss for member’s such transaction activities, member shall be responsible for compensating the loss of WREA and REC.
⑦	Unless WREA and REC indicatively agrees, Member cannot endorse, provide or use the service use authority and any other position on use agreement as collaterals to another. 
⑧	Member shall not do the following actions regarding the service use.
I.	Using another member’s ID, password and registration number etc.
II.	Copying the information acquired from the service for a purpose other than member’s individual use, publishing or broadcasting or providing it to a third party without WREA and REC’s approval.
III.	Posting and distributing the contents that violate another’s patent, trademark, business confidential information, copyright and other intellectual property rights via e-mail or other methods.
IV.	Sending, posting, or emailing or using any other methods to distribute the information, words, graphs etc. of vulgar and lustful contents that violates the general customs and public order to others with any other 
V.	Sending, posting, emailing or using any other methods to distribute insulting or threatening contents that can violate another’s privacy.
VI.	Such actions that are considered to be associated with crime in general,
VII.	Collecting or saving other user’s personal information without the approval of WREA and REC
VIII.	Other actions that are against the related regulations.

Chapter 4. Use of WREA and REC Service

Article 13 (Charged Service)

①	Contents and service provided by WREA can only be viewed or used after the full payment of the membership fee. Additional charged services can be used after paying the indicated amount for the relevant information.
②	REC provides the free programs for free, but if the member needs certificate of completion or license of such program, additional fee will be charged.

Article 14 (Postings of Member)

If WREA and REC shall find the postings or registered contents of the member relevant to the following clauses, they may delete it without prior notice.
I.	If it contains the content of blaming other member or a third party or damaging one’s dignity with scheming,
II.	If it contains the contents against the public order and general customs,
III.	If it has contents that are considered to be associated with criminal actions,
IV.	If it violates such rights including WREA and REC’s copyright, a third party’s copyright etc.
V.	If one posts pornography or links pornographic website,
VI.	If the posting doesn’t suit the characteristic of the posting board,
VII.	If it is considered to be violating other related law

Article 15 (Copyright of the Postings)

Rights on the data posted on WREA and REC website are as below.
I.	The individual who posted the posting shall have rights and responsible for it, and WREA and REC cannot use the posting for its beneficial purpose without the individual’s agreement other than posting it on its website. Yet, WREA and REC may have rights to post it for a non-profitable purpose.
II.	Member cannot commercially use the posted materials on WREA and REC websites or manufacture or sell the information acquired from the service.
III.	Illegally transferring the Postings or contents directly produced by WREA and REC without written consent to another website or media is prohibited, and in case of violation, legal actions will be taken.

Article 16 (Posting Advertisement and Transactions with the Adviser)

①	WREA and REC may post advertisements to provide resources to provide materials. Individuals who desire to use WREA and REC are considered to have agreed of the advertisement postings they are exposed to during the service use.
②	WREA and REC shall not be responsible for all loss or damages occurred as a result of member’s participation in advertiser’s promotion activities via WREA and REC or postings on WREA and REC website, or any related communication or any transactions made with the advertiser.

Article 17 (Commercial Transaction and Group Purchase)

①	In order to provide better materials to the member, WREA and REC may perform group purchase or commercial transactions.
②	WREA and REC may send related notices for commercial transactions and group purchases.
③	Initial responsibilities to provide after service of products purchased via commercial transaction and group purchases shall be on the product supplier and manufacturer.
④	For any other related matters, general commercial transaction regulations.

Article 18 (Service Time)

Unless there is a an issue related to WREA and REC’s business or any other technical issue, service shall be available 24 hours a day throughout the year in general. However, it does not apply on the days or time set by WREA and REC for regular maintenance etc.

Article 19 (Stop of Service etc)

WREA and REC may stop the service in the following cases.
I.	In case the service stop is necessary for facility maintenance etc.
II.	If period communication business set by electronics communication business law stopped the electronic communications service.
III.	For any other uncontrollable cases

Article 20  (Termination of Agreement and Limit of Usage)

①	If the member wishes to terminate the use agreement, member should request membership withdrawal via online system by oneself.
②	If member does not sign in for more than 2 month during free program, one’s access can be limited to protect member’s information and operational effectiveness. However, the member who had been limited one’s access may file a claim afterwards, and one may resume service immediately once REC finds the case reasonable.
③	WREA and REC may terminate the use agreement or stop the service for certain period without a prior notice if the member is involved in one of the following actions.
I.	If one used another’s personal information, ID and password
II.	If one’s registered name is not the legal name
III.	If a same user is registered with another ID
IV.	If one is involved in a behavior that damaged another’s dignity or disadvantaged another.
V.	If it violates the intellectual property right of WREA, REC, other member or a third party
VI.	If one intentionally distributed the contents against the public order and general customs
VII.	If the member is planning to use the service to hinder national interest or social public interest
VIII.	If one intentionally violates the operation of WREA and REC
IX.	If large amount of information is sent or advertising material is sent to obstruct the stable operation of WREA and REC
X.	If one spreads computer virus program etc that can initiate malfunction of information communications equipment or data destruction
XI.	If there is a correction request from external organizations such as Information and Communications Moral Committee (current Korea Communications Standards Commission) or it is considered to have authoritative interpretation related to the illegal election activities by the national election commission
XII.	If one copies, distribute or commercially uses the information acquired by WREA and REC resources without WREA and REC’s prior approval.
XIII.	If one breaches the use conditions set by WREA and REC including this agreement.

Chapter 6 Compensation for Loss and Others

Article 21 (Compensation for Loss)

WREA and REC shall not be responsible for any loss of the member occurred related to the service.

Article 22 (Exemptions of Responsibilities)

①	WREA and REC shall be exempted from the responsibilities to provide material and service in case it cannot provide material and service due to natural disaster or force of majeure equal to such.
②	WREA and REC shall not be responsible for the service malfunction caused by member’s fault.
③	WREA and REC shall not be responsible for the loss of the member caused by the acquired material or the member’s loss of expected advantage from the material and service.
④	WREA and REC shall not be responsible for the contents including information, material, credibility, and accuracy of such posted by the member on website.
⑤	Regarding the registered individual’s loss related to the website and service usage, WREA and REC shall not be responsible for any loss resulted by the registered individual’s intentional or negligence mistake.

Article 22 (Applicable Law and Jurisdiction)

①	Lawsuits occurring between WREA/REC and member shall be under the law of Republic of Korea.
②	Lawsuit regarding the conflicts occurred between WREA/REC and member shall be filed to the jurisdiction court of the civil law cases.

Supplementary Provision

①	This agreement is effective from November 1, 2013.
②	Previous agreement executed until October 31, 2013 shall be replaced with this agreement.

Information on the collection and use of personal information

Notification on Collecting Personal Information Collection and its Use

1.	Following personal information is collected for membership registration, consultation, and service request, etc.
①	Collected Data:
Name, date of birth, login ID, password, home phone number, home address, mobile phone number, e-mail address, legal representative’s information, affiliated group, service use history, access log, cookie, access IP information, payment record, and occupation etc.
②	Personal information collecting method
③	Membership registration via Homepage (membership registration, public posting board), written forms, and phone/fax
 
2.	Collected personal information is used for the following purpose.
①	To provide service under agreement and to calculate the service charge: 
Supplying contents, delivering the products or sending invoices, etc
②	Member Management:
To confirm user for member exclusive service, to identify each user, to prevent illegal use of imprudent members, to prevent unauthorized use, to check registration preference, to check age, to check whether legal representative agreed to collect personal data of a child under 14, to handle customer needs such as handling complaints, and to deliver notification
③	To use it in Marketing and Advertisement:
Develop and specialize a new service (product), deliver commercial information such as event etc, provide service and post advertisements based on the demographical characteristics, check access frequency or statistics on member’s use of service
④	Others:
Limit duplicate registration, preserving records for conflict resolution, checking pass or non-pass status of members on various types of test and publishing other related data

3.	Fundamentally, relevant data shall be deleted without hesitation after collecting and using personal information have served its purpose. Yet, following information is preserved for a certain period indicated below for a reason as stated below. 
①	Preserving Data:
Name, gender, login ID, password, home phone number, home address, mobile phone number, e-mail address, legal representative information, record of service use, access log, cookie, access IP data, payment history, affiliated group, recognition path
②	Reason for Preservation:
Based on user agreement and personal information handling
③	Retention Period:
As long as member keeps the status according to the user agreement and if it is required by the related law’s regulation, company shall preserve members’ information for a certain period as set by each related law.
- Records of Indication/Advertisement: 6 months (Customer Protection Law on Electronic commercial transactions etc)
-  Records of signing an Agreement or cancelling Agreement Cancelation etc: 5 years (Customer Protection Law on Electronic commercial transactions etc)
-  Records on payment and product supply, etc.: 5 years (Customer Protection Law on Electronic commercial transactions, etc.: 
-  Records on customers’ complaint or conflict handling: 3 years (Customer Protection Law on Electronic commercial transactions, etc.
-  Records on collecting/managing and using the credit information: 3 years (Use and protection law of Credit information)
- Communication fact confirmation data following the Communication Privacy Protection Law: 3 months
- If a jurisdiction requests for a case investigation due to improper use of service and to protect another member: 1 year

I agree with the collection of the above personal information.
